Terms & Conditions
1. Our Contract
These Terms and Conditions govern the supply of goods sold by SpecsOnTheNet Ltd (referred to as "we" and "us") of Cardiff Business Technology Center, Senghenydd Road, Cardiff, CF24 4AY through our website - www.specsonthenet.com.
SpecsOnTheNet Ltd is registered in 'England & Wales', company number 04950976. This contract is subject to and governed by United Kingdom law.
These Terms and Conditions in combination with the order form constitute the complete agreement between us and the customer. Our acceptance of your order by delivery of the goods constitutes a legally binding contract between us on these terms and conditions.
2. Conditions of Sale
Customers must be over 16 years of age and must not be registered blind or partially sighted.
Your prescription must have been issued within the last 2 years. If requested a copy of your prescription must be provided to us.
3. Price & Payment
3.1 The price payable for the goods you order is as set out on our website at the time you place your order plus any charges for carriage and insurance as set out in the order form.
3.2 We must receive payment for the whole of the price of the goods you order, and any applicable charges for carriage and insurance, before your order can be accepted.
3.3 Only one discount code or promotional code can be used per order.
4. Delivery & Title
Goods will be delivered in accordance with your order. A valid signature will be required on collection or delivery. Immediately after signing for delivery, title in the goods will pass to you. In the unlikely event that you have not received all the goods within 7 days of the date of delivery you must notify us immediately.
5. Availability
5.1 While we endeavour to hold sufficient stock to meet all orders, on the rare occasion where we have insufficient stock to supply the goods ordered and paid for by you, we will raise a full refund back to the original credit/debit card.
5.2 On the occasion that we are unable to handle your prescription and frame we will raise a full refund back to the original credit/debit card.
6.1 You have the right to cancel an order within 30 days of the date of delivery. Such notice may be given by mailing, faxing or emailing to the number or address set out on the order form. If you are cancelling because of any problem with the goods, please notify us of the problem at the time of cancellation.
6.2 We will refund the full cost of the frame on receipt of the returned goods in satisfactory condition.
6.3 We can only refund 50% of the cost of the lenses as they are customised items.
6.4 You must return the goods to us at your cost unless the goods are being returned because they are faulty or incorrect goods, in which case we will meet the cost of return but we ask that you allow us to nominate the carrier.
6.5 The cost of carriage and insurance is non-refundable.
7. Liability
7.1 If you have notified us of a problem with the goods, we will replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question.
We will not be liable to you for any administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer.
7.2 We shall not be liable for any errors made by you when entering prescription details online.
7.3 SpecsOnTheNet Ltd is registered in England and Wales and subject to United Kingdom Law. We make no legal provision for other countries and customers outside the UK take full and sole responsibility for compliance with the law in their own country.
8. Force Majeure
We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, strikes, lockouts and other industrial disputes.)
9. General
If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with United Kingdom law.
10. VAT
All prices include VAT at 15%.
11. Accessories
All frames come with one appropriate case and lens cloth. Case images are examples only and do not neccessarily represent the exact case supplied.
12. Design, Images and Reproduction
Whilst all care is taken during the photography and editing of the frame images the actual colour may vary slightly from that shown due to differences in monitor/LCD characteristics. Logos on the lenses are on the dummy lenses only and won't be on the completed spectacles.
Images, code, layout and style are all copyright. Reproduction in whole, or in part, is strictly prohibited without written permission.
